DWI With Injury

Texas Penal Code § 49.07 states that a person commits intoxication assault if they operate a motor vehicle (or an aircraft or watercraft) in a public place while intoxicated and cause serious bodily injury to another. This means that if an individual caused an accident and injury while driving intoxicated or under the influence of drugs, they can potentially face felony charges for intoxication assault.

DWIs involving injuries are a serious matter and prosecutors work aggressively to gain convictions. In order to prove that a defendant is guilty of intoxication assault, prosecutors must prove several legal elements. These include proving that a driver was either intoxicated or under the influence, was in a public place, and caused "serious bodily injury." Under Texas law, "serious bodily injury" is defined as any injury that:

  • Creates a significant risk of death; or
  • Causes permanent disfigurement; or
  • Causes loss or impairment of limbs or organs.

Penalties for Intoxication Assault in Texas

Intoxication assault is a third-degree felony and is punishable by:

  • 2 to 10 years imprisonment
  • Up to $10,000 in fines

Since felonies are punishable by mandatory minimum terms of imprisonment, the threat of losing your freedom is real. Additionally, felony convictions can pose long-term repercussions and limitations in your professional and financial future. When you also consider driver's license suspensions or revocations, collateral costs, and other associated consequences, it is clear that the penalties can profoundly affect your life.
