Field Sobriety Tests
When an individual has been pulled over, arrested or charged with a
DWI, it can be an extremely frightening and emotional experience. Many times
an individual's first run-in with law enforcement is after being pulled
over for a suspected DWI. Law enforcement officials will use field sobriety
tests, as well as
breath & blood tests, to help confirm and validate their suspicions that the driver they pulled
over was in fact driving while intoxicated.
Although your arrest may be based primarily on the results of your field
sobriety tests, these types of tests are not 100% accurate. In fact, I
have gotten many results from field sobriety tests dismissed because of
inaccuracies. The simple fact is that officers are not medical professionals,
therefore they are not medically qualified to properly administer an eye
test to determine if your response if "normal". Various factors
can alter or change a person's eye movement, and officers can only
estimate the measurement of eye movement, thus allowing for speculation
or inaccuracies. It is also a well-known fact that the medical community
does not accept eye tests as a valid method for determining whether or
not an individual is intoxicated. As for the other field sobriety tests,
your physical state, general health, level of anxiety or stress at the
time, can all impact your mental and physical abilities.
If you or a loved one has been charged with a DWI, especially if it was
based primarily on field sobriety test results, you need to consult with
an experienced
DWI lawyer at my firm today. For over 15 years, I have been representing clients
facing all manner of DWI charges, from
first time DWI to
DWI with injury, and even
felony DWI. My staff and I understand what you are going through and we will work
quickly to thoroughly review all the evidence in the case against you,
analyze all tests results and readings, challenge any discrepancies, and
fight to get your field sobriety test results dismissed.
Need help getting your field sobriety tests resulted dismissed?
Law enforcement officials and the prosecution tend to use field sobriety
test results as a way to charge you and collect further evidence against
you. When you think about it, however, how do activities you perform along
the side of a road objectively determine whether or not you were intoxicated?
Even people who were not intoxicated have failed field sobriety tests,
as the arresting officer considered they were completing the task in a
slow and deliberate manner. I am extremely familiar with fighting field
sobriety test results and will work aggressively to get yours dismissed as well.
My job is to take all the assumptions and speculation out of your case
and to fight aggressively to see that your interests and rights are protected.
I make myself available 24/7 to answer any questions you may have, and I treat each case as if it were
my own case. I do everything possible to see that my clients are protected,
because that is what I would want and expect on my own case. My staff
and I pride ourselves on delivering a higher level of service than most
small firms, and we are committed to professional excellence.
