Breath and Blood Tests for a Suspected DWI
There is no question that driving while intoxicated (DWI) is a serious charge and anyone who is arrested or charged with a DWI can expect to face heavy fines and penalties if they are convicted. That is because as soon as an intoxicated driver gets behind the wheel of a motor vehicle they are putting themselves and others at risk.
One of the primary ways law enforcement officials confirm a suspected DWI driver is to pull them over and administer field sobriety tests, along with
breath & blood tests. In the state of Texas, if a driver has a blood alcohol concentration of .08 or more, they are considered to be intoxicated. An individual can also be facing DWI drugs charges if they are found to be driving under the influence of prescription drugs, over-the-counter drugs or illegal drugs. Commercial drivers only need blow a .04 on the breath test in order to be charged with DWI, and drivers under the age of 21 who have a BAC of .02 or higher, can be charged with an
underage DWI.
If you or a loved one has been arrested or charged with DWI, you need to consult with The Samuelson Law Firm right away. Even if law enforcement administered breath & blood tests and arrested you based on the results of your tests, that doesn't mean you have no legal defense. Breath & blood tests are not infallible. Errors can be made. Operator error, an incorrectly calibrated machine, improper testing procedures as laid out by the Department of Public Safety Breath Testing Manual, and other circumstances can all cause false or inaccurate readings, and bring into question the validity of the test results.
