When it comes to using field sobriety tests to determine if you should be arrested for a Houston or Conroe DWI, there are certain restrictions regarding the tests that may be used.

Even when these tests are used, they are not flawless – and Conroe and Houston, TX DUI attorneys can question their reliability and accuracy.

If you are pulled over for a Houston or Conroe, Texas DWI, you may be asked to perform one of the following tests:

  • The walk and turn, also referred to as the head-to-toe
  • The Horizontal Gaze Nystagmus
  • The one leg stand

Although there is some evidence to show that these methods can be an indicator of whether or not a person was drinking, using them as a basis for a Houston or Conroe, Texas DWI arrest is questionable.

Each test is based on what the average person is expected to do. Obviously, very few people are average. We are all unique and, as such, our bodies respond to situations differently.

If you were feeling nervous or stressed or were recently ill -- or if you have a physical or mental disorder -- the results of these tests might be skewed.

Conroe and Houston, TX DUI attorneys know that these tests are performed by officers with no formal medical training. So even though these tests are accepted by the state for use in field sobriety testing, they really are not an accurate measurement of whether or not you should be arrested for a Houston or Conroe, Texas DWI.
