What To Do After Being Arrested Top 10 DWI Mistakes What Happens After a DWI Arrest?

Unlawful Police Stops

Getting pulled over for a suspected DWI offense, can be an extremely emotional and frightening experience. Many people's first run-in with law enforcement is when they are asked to pull over because of a suspected DWI. Then there is the humiliation of having to do field sobriety tests and breath & blood tests while on the side of the road, whether or not you are actually intoxicated. All in all, it is an experience most people would not wish to relive.

Should your tests indicate you have a blood alcohol concentration (BAC) over the legal limit, you may think there is no way you will be able to avoid a DWI conviction. That is not true. It is common knowledge that many such tests have a margin of error and are not infallible. There are also many factors which can sway or impact test results. A positive test result does not always mean you are guilty or that you will be convicted. An experienced DWI attorney from my firm will be able to review your case, analyze if proper procedures were followed, determine if the machines used to "verify" your BAC were properly calibrated and more.

How you were arrested can play a large role in your defense, and in determining whether or not you were the victim of an unlawful police stop or profile stop. Did the arresting officer have a reasonable suspicion for pulling you over AND arresting you? Were you asked to take a field sobriety test or ordered to do so? Did the arresting officer properly read your Miranda rights after you were arrested? How you were stopped and arrested have as such significance in your case, as why you were arrested. If proper procedures and laws were not properly followed, or mistakes were made, then The Samuelson Law Firm will work diligently to get the charges against you dropped.
