Houston DWI Lawyer: Ignition Interlock Devices

Why am I required to have an ignition interlock device on my vehicle?

In the state of Texas, when an individual has been convicted of a DWI, DWI with injury, or any of the various types of DWI, a judge will suspend their license as one of the penalties of their conviction. The judge will also decided whether or not the individual will be required to have an ignition interlock device (IID) on their vehicle. An ignition interlock device is a system that is designed to test for alcohol on a driver's breath and prevent the vehicle from starting if the resultant concentration is higher than the blood alcohol concentration allowed.

Judges will commonly order the installation of an ignition interlock device, as per Texas Transportation Code - Section 521.246, when an individual has multiple DWI convictions and they have had their license suspended after a conviction. Individuals are required to purchase and have the device installed at their own expense. The device will be required to remain installed for at least half of the individual's period of supervision. There are instances, however, when the court will allow the individual to operate a motor vehicle such as if they are required to do so in the course of their employment, if the vehicle they will be driving is owned by their employer, and if the vehicle is not owned or controlled by the individual who has restricted driving privileges.
