Field Sobriety Tests

When an individual has been pulled over, arrested or charged with a DWI, it can be an extremely frightening and emotional experience. Many times an individual's first run-in with law enforcement is after being pulled over for a suspected DWI. Law enforcement officials will use field sobriety tests, as well as breath & blood tests, to help confirm and validate their suspicions that the driver they pulled over was in fact driving while intoxicated.

Although your arrest may be based primarily on the results of your field sobriety tests, these types of tests are not 100% accurate. In fact, I have gotten many results from field sobriety tests dismissed because of inaccuracies. The simple fact is that officers are not medical professionals, therefore they are not medically qualified to properly administer an eye test to determine if your response if "normal". Various factors can alter or change a person's eye movement, and officers can only estimate the measurement of eye movement, thus allowing for speculation or inaccuracies. It is also a well-known fact that the medical community does not accept eye tests as a valid method for determining whether or not an individual is intoxicated. As for the other field sobriety tests, your physical state, general health, level of anxiety or stress at the time, can all impact your mental and physical abilities.
