When an individual is arrested or charged with a DWI, they are not only facing criminal charges, they are also facing a civil proceeding called an administrative license revocation (ALR) regarding the suspension of their drivers' license. Texas Transportation Code 724 states that any individual who operates a motor vehicle on Texas roadways has given an implied consent to provide a specimen during breath & blood tests, if they have been arrested for a DWI. The code further states that anyone who refuses to submit to such testing will face applicable consequences, such as the suspension of their drivers' license.

Texas courts do not recognize an individual's right to consult with a lawyer prior to making the decision to take the breath or blood test. If an individual refuses to take a breath or blood test, or they have a blood alcohol content (BAC) over the legal limit their drivers' license can and will be automatically suspended. Law enforcement officials are then required by law, to issue a temporary driving permit to the individual, which expires on the 41st day after its issuance. The only way to challenge a suspension in cases such as this, is to send a written request for a hearing within 15 days of receiving your notice of suspension. If no hearing is requested, then the suspension will automatically begin on the 41st day after notice was received.
